Are NRI,s holding OCI cards eligible / required to obtain Adhaar Card?

There seems to be quite a confusion whether NRI,s holding foreign passports required to obtain Adhaar Card.

As India does not provide for dual citizenship one has to surrender the Indian passport after getting citizenship of any other country. They can though obtain OCI (Overseas Citizen of India) card.

Why does the question or necessity of Adhaar card arises then. As many NRI,s have bought or ancestral properties in India from which they may be deriving some income. While some may be drawing service pensions in India. Therefore they may be required to file annual income tax returns for which PAN (Permanent Account Number) number is required.

Recently Government of India has introduced Adhaar Card, a unique identification number and have passed a legislation called Adhaar Act 2016. It has been made compulsory for Indians to quote Adhaar Card number as well as PAN number to file income tax returns and opening bank accounts.

Thus arises the question of requirement of Adhaar Card for NRI,s.

The confusion is further confounded due to the fact that the agencies entrusted with the job to issue Adhaar Card and the portal where one has to register to obtain Adhaar card (http://www.uidaadharcard.in/apply-aadhar-card-ocipoi) does not specify the eligibility and requirement to obtain Adhaar Card.

There is no confusion with regard to NRI,s holding Indian passports as they are just Indians for all intent and purpose.

As per the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act 2016, only a resident individual is entitled to obtain Aadhaar.

Resident as per the said Act means an individual who has resided in India for a period or periods amounting in all to one hundred and eight two days or more in the twelve months immediately preceding the date of application for enrollment.

In a nutshell as such NRI,s with OCI are not required to and eligible to get Adhaar Card however if you happen to spend 180 days or more in India then you are eligible and required to obtain one.
